The regular meeting of the Mayor and City Council of the City of Henderson, Nebraska was held at 7:30 p.m. on Tuesday, October 14, 2008 at City Hall in Henderson, Nebraska.

Notice of this meeting was posted at the City Hall and published in the October 9, 2008 Henderson News.             Mayor Lucas Epp called the meeting to order at 7:30 p.m. Mayor Epp declared the meeting to be legal and properly advertised with all members having been informed of the nature of the meeting and having received related information. Mayor Epp also referred to the open meetings law poster at the back of the council chambers.

             Roll call showed the following present: Mayor Lucas Epp. Council members: Matt Friesen, Scott Erb and Jim Mestl. Absent: Deb Friesen. Also present were the city clerk and city employees.

             Minutes from the September 9 and September 17, 2008 meetings were presented. Scott Erb made a motion to approve the minutes as presented. Jim Mestl seconded. Roll vote: Ayes - Scott Erb, Jim Mestl and Matt Friesen. Absent: Deb Friesen. Motion carried.

             Claims were presented. Jim Mestl made a motion to approve the claims as presented with the exception of the check for SENDD. Matt Friesen seconded. Roll vote: Ayes - Jim Mestl, Matt Friesen and Scott Erb. Absent: Deb Friesen. Motion carried.

             One building permit was submitted.

             Jerry Kabourek from M.E. Collins and Mike Kleffner from Olsson and Associates were present to give an update on the street progress. They plan on using fly ash to dry out the subgrade from the rains. Substantial completion means everything except for the seeding. The substantial completion date is December 1, 2008 with a $1,000 per day fine for every day not complete after December 1. No formal action taken.

             A company that specializes in crack router and sealing will be in contact with the city clerk for the swimming pool deck. No formal action taken.

             Gary Petersen from the York/Seward County Emergency Management division was present to discuss NIMS, emergency planning for the city, regulations that are required for cities in order to receive federal funding. No formal action taken.

             Dog ordinances were reviewed from other towns. The Henderson Code is in conjunction with many other towns Henderson’s size. The planning commission is writing an article to be put in the Henderson News and posted at the Post Office about the dog leash law and the pooper scooper law the City has in place. No formal action taken.

             Matt Friesen made a motion to adjourn. Scott Erb seconded. Roll vote: Ayes - Matt Friesen, Scott Erb and Jim Mestl. Absent: Deb Friesen. Motion carried.
