The regular meeting of the Mayor and City Council of the City of Henderson, Nebraska was held at 7:00 p.m. on Tuesday, October 1, 2013, at City Hall in Henderson, Nebraska. Notice of this meeting was posted at the City Hall, Post Office and published in the September 26, 2013 Henderson News.

             Mayor Ken Bergen called the meeting to order at 7:00 p.m. Mayor Bergen declared the meeting to be legal and properly advertised with all members having been informed of the nature of the meeting and having received related information. Mayor Bergen also referred to the open meetings law poster at the back of the council chambers.

             Roll call showed the following present: Mayor Ken Bergen. Council members: Mike Wall, Lee Thiessen, Jim Mestl and Scott Erb.

             Minutes from the September 10 and 23, 2013 meeting were reviewed. Mike Wall made a motion to approve the minutes with the change to the executive session part stating Milan Mierau was present for part of the executive session. Lee Thiessen seconded. Roll vote: Ayes - Mike Wall, Lee Thiessen, Jim Mestl and Scott Erb. Motion carried.

             Claims were reviewed. Jim Mestl made a motion to approve the claims as presented. Scott Erb seconded. Roll vote: Ayes - Jim Mestl, Scott Erb, Mike Wall and Lee Thiessen. Motion carried.

             No building permits were issued.

             Scott Erb made a motion to approve the Corrected Replat of Irregular Tract 30 to include the correct irrigation pipeline easement. Mike Wall seconded. Roll vote: Ayes - Scott Erb, Mike Wall, Lee Thiessen and Jim Mestl. Motion carried.

             Jim Mestl made a motion to accept Resolution 2013-06, the gifting of Replat IT 30, Lot A to the City of Henderson from Dr. Jim and Nora Ohrt. Mike Wall seconded. Roll vote: Ayes - Jim Mestl, Mike Wall, Scott Erb and Lee Thiessen. Motion carried.

             Mike Wall made a motion to authorize the conveyance of the Corrective Warranty Deed to Bernie and Carol Anderson for Lot B of Replat IT 26 to include “also known as Lot B of IT 26.” Jim Mestl seconded. Roll vote: Ayes - Mike Wall, Jim Mestl, Lee Thiessen and Scott Erb. Motion carried.

             Scott Erb made a motion to approve the Corrected Plat of Eastland 4th Addition for Bernie and Carol Anderson. Mike Wall seconded. Roll vote: Ayes - Scott Erb, Mike Wall, Jim Mestl and Lee Thiessen. Motion carried.

             Discussion of Providence Addition and utilizing local contractors/businesses was had with Charley Campbell, the city attorney. Many ideas were discussed. No formal action taken.

             With the discussion of Providence Addition next on the agenda, Mayor Ken Bergen stated he had turned in his conflict of interest papers with the clerk and excused himself as Mayor. Scott Erb at this time is the Acting Mayor as he is the President of the Council.

             Discussion on Providence Addition and hiring Ayars & Ayars for design purposes was had. It was suggested that Ayars & Ayars split the contract out to show the option for the city to do utilities now and add the paving of the street at a later time. Clerk will discuss with Ayars & Ayars and have on the next agenda. No formal action taken.

             Ken Bergen has resumed the position of Mayor for the next agenda item.

             Jim Mestl made a motion to adopt Resolution #2013-07, to accept the 180 day, 2 year, 4% discount for the city insurance through LARM. Lee Thiessen seconded. Ayes - Jim Mestl, Lee Thiessen, Mike Wall and Scott Erb. Motion carried.

             Scott Erb made a motion to accept Splashtacular’s bid to refinish the slide at the swimming pool. Jim Mestl seconded. Roll vote: Ayes - Scott Erb, Jim Mestl, Lee Thiessen and Mike Wall. Motion carried.

             Jim Mestl made a motion to pay the SENDD dues. Mike Wall seconded. Roll vote: Ayes - Jim Mestl, Mike Wall, Scott Erb and Lee Thiessen. Motion carried.

             Mike Wall made a motion to adjourn. Scott Erb seconded. Roll vote: Ayes - Mike Wall, Scott Erb, Lee Thiessen and Jim Mestl. Motion carried.
