The regular meeting of the Mayor and City Council of the City of Henderson, Nebraska was held at 7:30 p.m. on Tuesday, May 12, 2009 at City Hall in Henderson, Nebraska.

Notice of this meeting was posted at the City Hall and published in the May 7, 2009 Henderson News.             Mayor Ken Bergen called the meeting to order at 7:30 p.m. Mayor Bergen declared the meeting to be legal and properly advertised with all members having been informed of the nature of the meeting and having received related information. Mayor Bergen also referred to the open meetings law poster at the back of the council chambers.

             Roll call showed the following present: Mayor Ken Bergen. Council members: Jim Mestl, Deb Friesen, Scott Erb and Matt Friesen. Also present were the city clerk and city employees.

             Minutes from the April 14 meeting were reviewed. Deb Friesen made a motion to approve the minutes as presented. Scott Erb seconded. Roll vote: Ayes - Deb Friesen, Scott Erb, Matt Friesen and Jim Mestl. Motion carried.

             Claims were reviewed. Jim Mestl made a motion to approve the claims as presented. Matt Friesen seconded. Roll vote: Ayes - Jim Mestl, Matt Friesen and Deb Friesen. Abstain: Scott Erb. Motion carried.

             Two building permits were submitted

             Three sealed bids were received, opened and reviewed for the hydraulic loading ramp. The high bid was Burton Enterprises for $1,020. Matt Friesen made a motion to accept the high bid of Burton Enterprises. Scott Erb seconded. Roll vote: Ayes - Matt Friesen, Scott Erb, Deb Friesen and Jim Mestl. Motion carried.

             The resolution to adopt a Residential Lot Transfer Agreement for the two city owned lots in the Kroeker Subdivision was reviewed. Scott Erb made a motion to adopt resolution #2009-02. Jim Mestl seconded. Roll vote: Ayes - Scott Erb, Jim Mestl, Matt Friesen and Deb Friesen. Motion carried.

             The resolution to adopt a grant and/or loan application for the Downtown TIF District was reviewed. Matt made a motion to adopt Resolution #2009-03. Deb Friesen seconded. Roll vote: Ayes - Matt Friesen, Deb Friesen, Scott Erb and Jim Mestl. Motion carried.

             The North Industrial Park was discussed. It was decided to have the engineers start working on plans to redo 11th Street and to go out for bids on the sewer and 11th Street in the early part of 2010.

             Swimming pool admission rates were reviewed. The proposed rate increase after seven years is as follows:

             After reviewing the rate increases, Jim Mestl made a motion to adopt the proposed increases. Matt Friesen seconded. Roll vote: Ayes - Jim Mestl, Matt Friesen, Deb Friesen and Scott Erb. Motion carried.

             Wage increases for lifeguards were reviewed due to the minimum wage increase in July. The proposed increases are as follows:

             Manager & Assistant Managers              3% of hourly wage

             Jim Mestl made a motion to approve the proposed wage increases for the lifeguards. Scott Erb seconded. Roll vote: Ayes - Jim Mestl, Scott Erb, Deb Friesen and Matt Friesen. Motion carried.

             Two bids were received to construct a rail at the north inlet at the lake. The low bid was Beaver Creek Fencing for $575, installed and painted. Deb Friesen made a motion to approve Beaver Creek Fencing to construct the rail. Matt Friesen seconded. Roll vote: Ayes - Deb Friesen, Matt Friesen, Scott Erb and Jim Mestl. Motion carried.

             Reports were given. No formal action taken.
