The regular meeting of the Mayor and City Council of the City of Henderson, Nebraska was held at 7:30 p.m. on Tuesday, July 10, 2007 at the City Hall in Henderson, Nebraska.

             Notice of this meeting was posted at the City Hall and Henderson Post Office and published in the July 5, 2007 Henderson News.

             Mayor Lucas Epp called the meeting to order at 7:30 p.m. Roll call showed the following present: Mayor Lucas Epp. Council members: Matt Friesen, Jim Mestl, Deb Friesen and Scott Erb. Also present were the city clerk, city employee and representatives from Smith Hayes and Olsson & Associates.

             Minutes from the June 12 and June 18 meetings were presented. Matt Friesen made a motion to approve the minutes as presented. Deb Friesen seconded. Roll vote: Ayes - Matt Friesen, Jim Mestl, Deb Friesen and Scott Erb Motion carried.

             Claims were presented. Deb Friesen made a motion to approve the claims as presented. Jim Mestl seconded. Roll vote: Ayes - Matt Friesen, Jim Mestl and Deb Friesen. Abstain: Scott Erb Motion carried.

             One building permit was submitted.

             Scott Erb made a motion to table the fireworks special request until Shar Doell arrived. Matt Friesen seconded. Chief of Police Milan Mierau is suppose to be in contact with Shar Doell to explain the state regulations for special fireworks displays.

             Steve Buller of Aurora Cooperative was present to discuss the chemical spill along 17th Street, Front Street and N. Main Street. Steve explained the chemical spill cleanup and ramifications of the spill are Boardman Aerial’s responsibility and Aurora Cooperative is assisting. The chemical was Bicep and there has been soil testing done to see how far down the chemical is. There will be more testing done later this summer to see if it is leaching down. Bicep should not last long so seeding or sod should not be needed. Boardman’s/Aurora Cooperative will send a letter to property owners explaining what will need to be done after the soil testing results are back.

             Mike Kleffner of Olsson and Associates was present to discuss the interior design for fire rating on the wellhouse with the generator. Discussion was also had on applying for a grant from NHHS for a fence around wellhouse #3. Matt Friesen made a motion to apply for the grant. Jim Mestl seconded. Roll vote: Ayes - all. Motion carried.

             A public hearing will be held on August 14 for the street district.

             Scott Erb made a motion to adopt Ordinance #362, an ordinance creating a street improvement district for paving, grading, curbing, guttering and other necessary and incidental work; providing for the payment to such improvements and other incidental expenses by the issuance of warrants, bond anticipation notes and bonds; providing for assessment of the costs of such improvements against the property specially benefitted thereby and the levy of general taxes. Deb Friesen seconded. Roll vote: Ayes - all. Motion carried.

             Deb Friesen made a motion to suspend the three readings on three different days for Ordinance #362. Matt Friesen seconded. Roll votes: Ayes - all. Motion carried.

             Matt Friesen made a motion to accept the street improvement plans and authorize publication for bidding. Scott Erb seconded. Roll vote: Ayes - all. Motion carried.

             Matt Friesen made a motion to adjourn. Jim Mestl seconded. Roll vote: Ayes - all. Motion carried.
