The regular meeting of the Mayor and City Council of the City of Henderson, Nebraska was held at 7:00 p.m. on August 8, 2017 at City Hall in Henderson, Nebraska. Notice of this meeting was posted at the City Hall and Post Office and published in the August 3, 2017 Henderson News.

             Mayor Mike Yoder called the meeting to order at 7:00 p.m. Mayor Yoder declared the meeting to be legal and properly advertised with all members having been informed of the nature of the meeting and having received related information. Mayor Yoder also referred to the open meetings law poster at the back of the council chambers.           Roll call showed the following present: Mayor Mike Yoder. Council members: Mike Wall and Jeb Mierau. Absent: Lee Thiessen and Corbin Tessman. With two council members absent, state statute gives the mayor of a second class the right to vote on a city council action when his or her vote will provide the additional vote required to create a number of votes equal to the majority of the council.

             Public forum was opened to the floor. Friesen Avenue resident Dave Bridges expressed his continued concern with the weeds in the park. No formal action could be taken.

             Building permit for the previous month was Corbin Tessman for an addition to the house.

             Tony and Debbie Homolka Don Regier, Jeremy and Adrianne Mills, Loren Huber were present to express their opinions on the sidewalk on the east side of 12th Street. Mayor Yoder explained the concern of the shorter driveways on the east side of 12th Street and vehicles parked in the driveways were blocking the sidewalks so the decision had been made to move the sidewalk to the curb. With this decision some of the residents were concerned with the roots of their trees and snow removal. Other residents expressed their support of moving to the curb due to health issues and the added walking distance if vehicle could not be parked in driveway anymore because state law prevents vehicles from blocking sidewalks. The council took into consideration the concerns and discussed having the engineers draw up plans for some sidewalk to stay where they are currently and others to be moved to the back of curb. After more discussion, Jeb Mierau made a motion to leave the whole sidewalk where currently located and not move to the back of curb. Mike Wall seconded. Roll call: Ayes - Jeb Mierau and Mike Wall. Nays - Mike Yoder. Absent: Lee Thiessen and Corbin Tessman. Motion carried.

             The council discussed the letter from the Henderson Housing Authority director Shari Peters to ask for a letter of support to merge units at Midtown Manor to make bigger apartments to rent out. Mike Wall made a motion to have the clerk write a letter of support for the merging of the units at Midtown Apartment. Jeb Mierau seconded. Roll vote: Ayes - Mike Wall, Jeb Mierau and Mike Yoder. Absent: Lee Thiessen and Corbin Tessman. Motion carried.

             Jeb Mierau made a motion to approve Resolution #2017-02, a resolution to enter into an agreement with LARM Insurance for a 4% discount with a 2-year commitment and 180 day termination notice. Mike Wall seconded. Roll vote: Ayes - Jeb Mierau, Mike Wall and Mike Yoder. Absent: Lee Thiessen and Corbin Tessman. Motion carried.

             The Providence Subdivision covenants were discussed as this was a concern from residents at the July council meeting. After discussion, Jeb Mierau expressed his concern that by changing the covenants now it will only create more issues. The purpose of the subdivision was to get lots available and to get people to build. Mike Wall and Mike Yoder both agreed. No formal action taken.

             Mike Wall made a motion to convene as the Community Development Agency (CDA). Jeb Mierau seconded. Roll vote: Ayes - Mike Wall, Jeb Mierau and Mike Yoder. Absent: Lee Thiessen and Corbin Tessman. Motion carried.

             Mike Wall made a motion to approve Resolution #2017-03. The resolution allows an amendment to the Redevelopment Plan of the City of Henderson; the implementation of a specific phase of a redevelopment project in the redevelopment area; the authorization of the use of tax increment financing; the adoption of the cost benefit analysis for said phase; the authorization and approval of a redevelopment agreement for the phase of the redevelopment project; and to take other actions required or permitted under the Community Development Law for Providence Subdivision for Lot 10. Jeb Mierau seconded. Roll vote: Ayes - Mike Wall, Jeb Mierau and Mike Yoder. Absent: Lee Thiessen and Corbin Tessman. Motion carried.

             Mike Wall made a motion to approve the Amended and Restated Cost Benefit Analysis for Lot 10 of the Providence Subdivision Redevelopment. Jeb Mierau seconded. Roll vote: Ayes - Mike Wall, Jeb Mierau and Mike Yoder. Absent: Lee Thiessen and Corbin Tessman. Motion carried.

             Jeb Mierau made a motion to approve the Amended and Restated Plan Amendment to the Redevelopment Plan for Lot 10 in the Providence Subdivision. Mike Wall seconded. Roll vote: Ayes - Jeb Mierau, Mike Wall and Mike Yoder. Absent: Lee Thiessen and Corbin Tessman. Motion carried.

             Mike Wall made a motion to approve the Redevelopment Agreement for Lot 10 in the Providence Subdivision with Kevin and Rebecca Schultz. Jeb Mierau seconded. Roll vote: Ayes - Mike Wall, Jeb Mierau and Mike Yoder. Absent: Lee Thiessen and Corbin Tessman. Motion carried.

             Jeb Mierau made a motion to approve the Purchase Agreement for Lot 10 in the Providence Subdivision with Kevin and Rebecca Schultz. Mike Wall seconded. Roll vote: Ayes - Jeb Mierau, Mike Wall and Mike Yoder. Absent: Lee Thiessen and Corbin Tessman. Motion carried.

             Jeb Mierau made a motion to reconvene as city council. Mike Wall seconded. Roll vote: Ayes - Jeb Mierau, Mike Wall and Mike Yoder. Absent: Lee Thiessen and Corbin Tessman. Motion carried.

             Reports were given. Water and sewer rates to be reviewed since it has been 10 years since last increase. Speed limit sign or speed bumps were discussed for school alley, chicken ordinance will be revisited, budget study night will be set. No formal action taken.
