The regular meeting of the Mayor and City Council of the City of Henderson, Nebraska was held at 7:30 p.m. on Tuesday, April 14, 2009 at City Hall in Henderson, Nebraska.

Notice of this meeting was posted at the City Hall and published in the April 9, 2009 Henderson News.             Mayor Ken Bergen called the meeting to order at 7:30 p.m. Mayor Bergen declared the meeting to be legal and properly advertised with all members having been informed of the nature of the meeting and having received related information. Mayor Bergen also referred to the open meetings law poster at the back of the council chambers.

             Roll call showed the following present: Mayor Ken Bergen. Council members: Jim Mestl, Deb Friesen, Scott Erb and Matt Friesen. Also present were the city clerk and city employees.

             Minutes from the March 10 meeting were reviewed. Matt Friesen made a motion to approve the minutes as presented. Jim Mestl seconded. Roll vote: Ayes - Matt Friesen, Jim Mestl, Scott Erb and Deb Friesen. Motion carried.

             Claims were reviewed. Deb Friesen made a motion to approve the claims as presented. Jim Mestl seconded. Roll vote: Ayes - Deb Friesen, Jim Mestl and Matt Friesen. Abstain: Scott Erb. Motion carried.

             Four building permits were submitted.

             Scott Erb made a motion to adopt policy to pay for curb cuts for residential, commercial and industrial up to $300 when the project consists of new construction. This is effective as of March 1. Matt Friesen seconded. Roll vote: Ayes - Scott Erb, Matt Friesen, Jim Mestl. Nays - Deb Friesen. Motion carried.

             The North Industrial Park sewer assessment options were discussed with the city attorney. The property owners do not have the option to object the sewer district. The city can assess the cost to the property owners an amount agreed upon, but do not have to if it is determined it is a general benefit for the city. No formal action taken.

             The final plat of the North Shore First Addition was reviewed. Jim Mestl made a motion to approve the final plat. Scott Erb seconded. Roll vote: Ayes - Jim Mestl, Scott Erb, Deb Friesen and Matt Friesen. Motion carried.

             Water sampling was discussed for private entities. It was decided the city will only do water sampling for other towns when needed and only help for a short period of time for private entities until the license can be obtained by the entity.

             Matt Friesen made a motion to have Henderson Metal build a skid mounted sewer jetter for $5,400. Deb Friesen seconded. Roll vote: Ayes - Matt Friesen, Deb Friesen, Scott Erb and Jim Mestl. Motion carried.

             The sewer main in the alley between 17th and 18th Street was discussed. It was decided to have Nebraska Rural Water to come back out with their camera to video the line.

             Two bids were reviewed to service the two generators, one at the well and the other at the sewer lift station. Deb Friesen made a motion to accept BJ Harris’s bid for $1,000 to service the generators twice a year. This is to be reviewed after one year of service. Jim Mestl seconded. Roll vote: Ayes - Deb Friesen, Jim Mestl and Matt Friesen. Nays - Scott Erb. Motion carried.

             Insurance discounts with LARM were reviewed. Scott Erb made a motion to adopt Resolution 2009-01, a resolution establishing an interlocal agreement between the city and LARM allowing for a 4% discount over a two year period with a written notice of termination at least 180 days notice prior to termination date. Matt Friesen seconded. Roll vote: Ayes - Scott Erb, Matt Friesen, Jim Mestl and Deb Friesen. Motion carried.

             Matt Friesen made a motion to have Kelsey Bergen be the city’s representative for York County Development Corporation. Scott Erb seconded. Roll vote: Ayes - Matt Friesen, Scott Erb, Jim Mestl and Deb Friesen. Motion carried.

             Reports were given. No formal action taken.
