The regular meeting of the Mayor and City Council of the City of Henderson, Nebraska was held at 7:30 p.m. on Tuesday, April 13, 2004 at the City Hall in Henderson, Nebraska.


Notice of this meeting was posted at the City Hall, U.S. Post Office and the Henderson State Bank and published in the April 1, 2004 Henderson News.


Mayor Curt Friesen called the meeting to order at 7:30 p.m. Roll call showed the following present: Mayor Curt Friesen and Councilmen: Al Cruickshank, Mark Kroeker, Matt Friesen and Scott Erb. Also present was the city clerk.


Minutes from the regular meeting March 9, 2004 were presented. Matt Friesen made a motion to approve the minutes. Mark Kroeker seconded. Roll vote: Ayes - Matt Friesen, Mark Kroeker, Al Cruickshank and Scott Erb. Motion carried.


Claims were presented and studied. Mark Kroeker made a motion to accept claims as presented. Al Cruickshank seconded. Roll vote: Ayes - Matt Friesen, Mark Kroeker and Al Cruickshank. Abstain: Scott Erb. Motion carried.


Two building permits were issued.


The lake renovation progress was discussed. Mark Kroeker made a motion to approve change orders #1 and #2 in the amount of $10,462. Matt Friesen seconded. Roll vote: Ayes - Matt Friesen, Mark Kroeker, Al Cruickshank and Scott Erb. Motion carried.


Scott Erb made a motion to approve application payment #2 to Kohl Construction in the amount of $41,005.67. Al Cruickshank seconded. Roll vote: Ayes - Matt Friesen, Mark Kroeker, Al Cruickshank and Scott Erb. Motion carried.


Matt Friesen made a motion to authorize the County to add a 150' culvert to the end of the storm sewer on South Main and to cost share half of the project and not to exceed the amount stated. Also utilities are not to be relocated. Scott Erb seconded. Roll vote: Ayes - Matt Friesen, Mark Kroeker, Al Cruickshank and Scott Erb. Motion carried.


The second reading of the Soil Sampling Ordinance was held. Russ Geirhart from the Upper Big Blue NRD was present to discuss with the council any changes. Scott Erb made a motion to advance the ordinance to the third reading with the changes discussed with Russ Geirhart. Mark Kroeker seconded. Roll vote: Ayes - Matt Friesen, Mark Kroeker, Al Cruickshank and Scott Erb. Motion carried.


Norene Fitzgerald from the York County Development Corporation presented the results of the York County Housing Study. No formal action taken.


Al Cruickshank made a motion to approve the change order submitted by Diamond Engineering in the amount of $10,720. Scott Erb seconded. Roll vote: Ayes - Matt Friesen, Mark Kroeker, Al Cruickshank and Scott Erb. Motion carried.


Pool manager Becky Franz presented new pool rates to the council. Matt Friesen made a motion to approve the new rates. Scott Erb seconded. Roll vote: Ayes - Matt Friesen, Mark Kroeker, Al Cruickshank and Scott Erb. Motion carried. 2004 rates are as follows:

Scott Erb made a motion to authorize the clerk to have sidewalk installed around the swimming pool for the pavers to be placed in. Al Cruickshank seconded. Roll vote: Ayes - Matt Friesen, Mark Kroeker, Al Cruickshank and Scott Erb. Motion carried. Landscaping and lighting to be on next months agenda.


Scott Erb made a motion to authorize the purchase of a nail drag for the ball diamonds with an extra set of nails. Matt Friesen seconded. Roll vote: Ayes - Matt Friesen, Mark Kroeker, Al Cruickshank and Scott Erb. Motion carried.


Economic development and housing discussed. No formal action taken.
