Article 4. Trees and Plantings


§8-401               TREES AND PLANTINGS; PLANTING BY OWNER REQUIREMENTS. (1) Any person may plant shade or ornamental trees adjacent to the streets of the Municipality, if he shall make application in writing with the Municipal Clerk addressed to the Mayor and City Council so to do and if permitted, allowed or directed to do so by the City Council̓s resolution; and the terms of such resolution shall be strictly followed.

             (2)        It shall be the duty of the person about to plant trees adjacent to any street to call upon the City Engineer who shall properly mark the line on which the frees may be planted. (Ref 18-801 through 18-807 RS Neb.)


§8-402               TREES AND PLANTINGS; SPACE BETWEEN CURB LINE AND LOT LINE. It shall be the duty of any owner or occupant of any lot abutting upon any street or avenue in the Municipality, to keep the space between lot line and curb line on the street or avenue free and clear of all weeds, rubbish or other obstructions. Every such owner or occupant may improve such space and cultivate it as a lawn, with grass, ornamental shrubbery and flowers; and when such space is so improved and cultivated, it shall be unlawful for any person to lead, ride or drive any animal or vehicle upon such space, or, in any manner, to injure or deface the lawn, shrubbery or flowers so planted or cultivated thereon.


§8-403               TREES AND PLANTINGS; ADDITIONAL PARKING. The Mayor and City Council may, by ordinance or resolution, order or permit the parking or improvement for lawn, flowers or shrubbery of any other or further portions of any street or avenue in the Municipality, which shall not be, in their judgment, necessarily required for actual travel; and, when so parked, planted or improved, it shall be unlawful for any person to lead, ride or drive any animal or vehicle upon, or, in any manner, to injure or deface the portion of the street so parked or improved.


§8-404               TREES AND PLANTINGS; STREET COMMISSIONER; ABSENCE OF CITY ENGINEER; DUTIES. If there be no duly qualified and acting City Engineer in the Municipality, the Street Commissioner shall perform all the duties which this Article requires of the City Engineer. (Ref 17-604 RS Neb.)
